Article 1: General provisions

The e-commerce website of bv De Clippel, a private limited company with registered office at Zwarte Zustersstraat 4 - 9300 Aalst, BTW BE 0424 005 509, RPR Dendermonde, (hereinafter referred to as 'bvba De Clippel') offers its customers the opportunity to purchase the products from its online store to buy.

These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). Placing an order via the Cocinella web shop implies that the Customer has consulted these Conditions and expressly accepts the applicability of these Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted by Cocinella in advance, in writing.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other duties or taxes required by the Customer.
If delivery costs are charged, this will be stated separately.
The price statement refers exclusively to the articles as described verbatim. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding on Cocinella. Cocinella is only bound to an obligation of means with regard to the correctness and completeness of the information provided. Cocinella is in no way liable in the event of material errors, typesetting or printing errors.

If the Customer has specific questions about, for example, sizes, colour, availability, delivery time or delivery method, we request that the Customer contact our customer service in advance.

The offer is valid while stocks last and can be adjusted or withdrawn by Cocinella at any time. Cocinella cannot be held liable for the unavailability of a product.

Article 4: Online purchases

The Customer selects the items and places them in the shopping cart.
•    When the order is complete, the Customer goes to the shopping cart where he gets an overview of the order.
•    On the next page, the Customer can register or log in if the Customer is already known. The Customer can also adjust his delivery address here.

The Customer has the choice between the following payment methods:
•    by credit card
•    via bank card (Belgium)
•    via Paypal (Netherlands)

The products offered through this e-commerce website constitute an offer subject to the condition of acceptance by Cocinella.

Cocinella is entitled to refuse an order (in writing) due to a serious shortcoming of the Customer with regard to the order or any other order or agreement in which the Customer is involved.

Article 5: Delivery and execution of the agreement

We strive to deliver all purchased items as quickly as possible, within 2 - 5 working days. Some items have a longer delivery time. This is always stated with the article.

The delivery time of an order is determined by the item with the longest delivery time.

Items ordered through this web store are delivered in Belgium, the Netherlands, France, Germany and others ........ via Bpost

After 2 offers you can pick up the package at a postal point (Bpost).

- A number of articles can only be picked up in our store, this is always clearly stated with the article. If you wish to have an item that can only be collected, delivered, you can always contact us for the delivery conditions of those items.

For all items that can be shipped:

- For Belgium, the shipping costs are 8 Euros for a purchase amount less than 50 Euros, from 50 Euros delivery is free. (up to 2kg)

You can also choose to pick up the purchased items for free in our store. (Stationsstraat 21 - 9300 Aalst)

Unless otherwise agreed, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately by the Customer to Cocinella.

The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice is not made by Cocinella.

Article 6: Retention of title

The delivered items remain the exclusive property of Cocinella until full payment by the Customer.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who purchase items online from Cocinella in their capacity as consumers.

If the right of withdrawal applies:

The Customer has the right to withdraw from the agreement within a period of 14 calendar days without stating reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last shipment or the last part.

To exercise the right of withdrawal, the Customer must inform bvba De Clippel - Cocinella, Stationsstraat 21 - 9300 Aalst, [email protected]  via an unambiguous statement (e.g. in writing by post or e-mail) of its decision. to revoke the agreement.

In order to comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Cocinella, Stationsstraat 21 - 9300 Aalst without delay, but in any case no later than 14 calendar days after the day on which he has notified De Clippel of his decision to withdraw from the agreement. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

***  These costs are borne by the customer.

If the returned product is in any way diminished in value,  Cocinella reserves the right to hold the Customer liable and claim compensation for any loss in value of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Outside of Europe: Taxes and customs fees are not included.

If the Customer withdraws from the agreement, Cocinella will refund to the Customer all payments received from the Customer up to that point, including the cost of the standard delivery costs, within a maximum of 14 calendar days after Cocinella has been informed of the Customer's decision to to revoke the agreement. In the case of sales contracts, Cocinella may withhold reimbursement until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.
Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by  Cocinella will not be refunded.

Cocinella will refund the Customer with the same payment method with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.

Article 8: Warranty

Pursuant to the law of 21 September 2004 concerning the protection of consumers in the sale of consumer goods, the consumer has statutory rights. This legal guarantee applies from the date of purchase by (if applicable from delivery to) the first owner. Every commercial guarantee leaves these rights unabated.

To make an appeal to the guarantee, the Customer must be able to present the proof of purchase. Customers are advised to keep the original packaging of the goods.

For articles that were purchased online and delivered to the Customer's home, the Customer must contact the Cocinella customer service beforehand, after which the Customer must return the article to Cocinella at his expense.

In determining a defect, the Customer must inform Cocinella as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after it has been determined. Afterwards, no right to repair or replacement lapses.

The (commercial and / or legal) warranty is never applicable to defects arising as a result of accidents, neglect, falls, use of the article in violation of the purpose for which it was designed, non-compliance with the instructions for use or instructions, modifications or changes to the article, crackdown, poor maintenance, or any other abnormal or incorrect use.

It also does not apply to items with a shorter life span, or wear articles.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, shall be deemed to be no hidden defects, unless the Customer proves otherwise.

The guarantee is not transferable.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights held by Cocinella, the Client shall owe an interest of 10% per year on the unpaid amount in the event of non-payment or late payment from the date of default. In addition, the Customer is legally and without notice a flat-rate compensation of 10% on the amount involved, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Cocinella reserves the right to take back the (fully) paid items.

Article 11: Privacy

The person responsible for the processing, Cocinella respects the Belgian law of 8 December 1992 concerning the protection of privacy in the processing of personal data.

The personal data you provide will only be used for the following purposes: processing and delivering the order, sending newsletters, advertising and / or marketing purposes.

You have a legal right to inspect and correct your personal data. Article 12: Use of cookies

Article 14: Change of conditions

These Terms and Conditions are supplemented by other conditions that are explicitly referred to and the general terms and conditions of Cocinella. In case of contradiction, these Terms and Conditions prevail.

Cocinella may change these Terms and Conditions without notice. Any purchase after the change implies an acceptance by the Customer of these new Terms and Conditions.

Article 15: Evidence

The Customer accepts that electronic communications and backups can serve as proof.

Article 16: Applicable law - Competent court

Belgian law applies, with the exception of the provisions of private international law with regard to applicable law and with the Rome-I regulation on international purchase agreements concerning movable property. In case of disputes, only the courts in Dendermonde are competent.
